In these Terms of Trade, “True Spec Plumbing” refers to the trading entity providing the goods and services.
“Customer” means the purchaser of goods and/or services.
All goods and services supplied by True Spec Plumbing are supplied subject to these Terms of Trade.
Any instruction, order, or acceptance of a quote constitutes acceptance of these Terms of Trade.
All prices are exclusive of GST unless otherwise stated. GST will be charged where applicable.
Prices are subject to change without notice. The price payable is the price applicable at the time the goods or services are supplied.
A vehicle/service charge may be applied unless otherwise agreed. This charge covers costs including fuel, travel time, registration, insurance, and vehicle maintenance.
Labour charges include time spent travelling to and from the job site, sourcing materials, and job-related administration.
Payment terms are stated on each invoice. Unless otherwise agreed, payment is due within 7 days from the invoice date.
True Spec Plumbing reserves the right to request full or part payment prior to commencement of works
The Customer must not withhold, set off, or deduct any amount from monies owing unless agreed in writing.
Overdue accounts may incur interest at 5% per month, calculated daily until paid.
The Customer is liable for all costs incurred by True Spec Plumbing in recovering overdue amounts, including debt collection and legal costs.
True Spec Plumbing may suspend or cease works while any account remains overdue.
Credit is provided at the discretion of True Spec Plumbing and may be withdrawn at any time.
Any order, instruction, or acceptance of a quote constitutes acceptance of these Terms, regardless of any conflicting terms provided by the Customer.
If the Customer suspends or cancels work, True Spec Plumbing may charge for work completed, materials ordered, and any costs incurred as a result.
Progress claims may be issued weekly and are payable within 7 days of the invoice date.
Any undisputed portion of an invoice must be paid in accordance with the payment terms.
The Customer must notify True Spec Plumbing in writing within 7 days of receiving an invoice of any dispute.
Both parties agree to attempt to resolve disputes promptly and in good faith.
Quotes are valid for 30 days unless otherwise stated.
Quotes are based on costs at the time of quoting and may be subject to variation due to supplier price changes or availability.
Quotes exclude GST unless stated otherwise.
Where material costs increase after acceptance of a quote, the increase may be passed on to the Customer.
Travel time and travel costs are included unless otherwise stated.
Materials purchased in advance may be invoiced prior to installation.
Any retention amounts must be disclosed and agreed in writing at the time of quote acceptance
Variations to the agreed scope of work will be charged separately and invoiced in accordance with these Terms.
Ownership of goods remains with True Spec Plumbing until payment is received in full.
Goods delivered to site become the responsibility of the Customer and should be covered by appropriate insurance.
True Spec Plumbing may recover unpaid goods where legally permitted.
This clause creates a security interest under the Personal Property Securities Act 2009 (Cth).
Any subcontractors engaged by True Spec Plumbing must comply with applicable health and safety legislation and site requirements.
True Spec Plumbing is not liable for delays or failure to perform due to circumstances beyond reasonable control.
Where services are supplied for business purposes, liability is limited at True Spec Plumbing’s option to rectification of defective work or refund of the portion of work proven to be defective.
No liability applies where work has been altered, misused, or affected by third parties or abnormal conditions.
Claims must be notified within 7 days of a defect becoming apparent and within 12 months of completion of works.
Workmanship is warranted for work carried out by True Spec Plumbing.
Warranty does not cover damage caused by third parties, flooding, or external events; lack of maintenance or misuse; continued use after a fault is identified; unpaid works; existing conditions beyond reasonable control; or properties sold after installation.
Statutory guarantees apply in accordance with the Australian Consumer Law and Building Act 1993 (Vic) where applicable.
True Spec Plumbing reserves the right to amend these Terms of Trade at any time.
